The Heights operates a simple, transparent booking process designed to protect both you and us. Our formal Rules of Conduct (PDF) will be sent to you upon enquiry approval and must be signed before your booking is secured.

How it works

1. Enquiry submitted · You complete the enquiry form on this site (or contact us via WhatsApp / email) with your dates and party size.

2. Confirmation & Rules of Conduct sent · We confirm availability and send you our Rules of Conduct PDF covering occupancy, noise, pets, parking, the estate's HOA rules, and enforcement.

3. Rules of Conduct signed · You review, sign, and return the document by email. This formalises your acceptance of the rules of stay.

4. Deposit paid & booking secured · Once the signed document is received and the deposit has been paid, your dates are reserved and a booking confirmation with a sequential booking reference is issued.

5. Balance & arrival details · The balance is paid by [insert your timeline]. On arrival, you register at the estate gate and we hand over keys.

6. Pre-arrival check-in form · Once payment is confirmed, you'll receive a link to our online Check-in Registration form. Please complete it before arrival — we'll forward your driver and vehicle details to the estate's main gate so you're cleared to enter on arrival day.

Why we ask for a signed document

The signed Rules of Conduct give both parties clarity from day one — there are no surprises about the no-pets policy, the 30 km/h estate speed limit, occupancy limits, the 8pm music curfew, or refuse handling. It also protects against fraudulent bookings and gives you confidence that you're dealing with the genuine landlord.

5-day cancellation window. You may cancel without penalty up to 5 days before your check-in date. Simply email or WhatsApp us and we will refund your deposit in full.

Late cancellation (less than 5 days notice). Failing to cancel within the 5-day window incurs a 25% handling fee of the total booking value. This covers the short-notice loss of revenue for that period and the lost opportunity for other guests.

Reasonable emergency exception. If a cancellation is due to a documented emergency (medical, bereavement, force majeure) we will refund the deposit in full at our discretion on presentation of proof.

Deposits required to confirm. A booking is only confirmed once the deposit has been received and your signed Rules of Conduct have been returned. Until then, your dates remain on a 48-hour hold.

The Rules of Conduct govern your stay at The Heights and are aligned with the Whale Rock Heights Estate Home Owners Association requirements. The signed document forms part of your booking agreement.

Parties to the Agreement

Short Term Let — Term

The lease runs from your check-in date to your check-out date for the total rental days agreed (a 14-day minimum applies), unless terminated due to non-compliance with the Rules of Conduct within the Estate. Termination procedure: one warning via WhatsApp; thereafter a fine and eviction may be issued.

Whale Rock Heights Estate

The main objective of Whale Rock Heights is to provide a high-quality lifestyle for residents, and the purpose of these Rules is to protect this lifestyle.

1. Access Control & Security

• Entry Protocol: All vehicle registration numbers of Visitors and the property to be visited must be recorded at the entrance to the Estate.
• Confirmation: Visitors will be granted access to the Estate only after telephonic confirmation has been obtained from the Member or Tenant to be visited.
• Conduct: Security personnel must be treated with co-operation and courtesy.
• Responsibility: Members and Tenants remain responsible for the conduct of Visitors and persons entering the Estate at their invitation or request.

2. Noise & Good Neighbourliness

• Acceptable Levels: The volume of music or electronic instruments and partying should be kept at a generally acceptable level.
• Curfew: Music should not be played outside, or on patios, after 8pm.
• Disturbance: No activity which causes aggravation or nuisance to fellow residents may be conducted.

3. Pets — Tenant & Visitor Policy

• Restriction: Tenants and Visitors will not be allowed to keep animals in the Estate.
• Control: The Association reserves the right to require a pet to be removed from the Estate should it become evident that it is on the premises.

4. Use of Streets & Environment

• Speed Limit: The general speed limit in the Estate is 30 km/h.
• Parking: Parking on sidewalks, on Open Space, and in the street opposite traffic islands is prohibited.
• Environment: It is prohibited to fish, release any fish into, swim, or allow dogs to swim or play in the pond, or interfere with wildlife.

5. Occupancy & Refuse

• Capacity: The maximum occupancy allowed in the Estate is 2 persons per bedroom.
• Waste: All refuse must be placed in wheelie bins; bins should not be placed on the sidewalk except on the day of collection.

Enforcement

The Trustees shall be entitled to impose a suitable penalty for rule contravention. The penalty shall be a fine of not less than R1 000.00. If the person is a Tenant or Visitor, the Member (Landlord) will be liable for payment of such fines.

Acknowledgement & Signature

By signing the Rules of Conduct PDF, you acknowledge: "I, the undersigned, acknowledge that I have read the Conduct Rules and agree to abide by them during my stay."

When you submit an enquiry through our website or contact us via WhatsApp / email, we may collect: your name, email address, phone number, requested check-in / check-out dates, number of guests, cleaning preference, and any free-text message you send. 3. Purpose of Processing

Your personal information is processed for the purposes of (a) responding to your enquiry, (b) confirming and managing your booking, (c) registering you with the estate's security on arrival, and (d) keeping a record of past stays for any necessary follow-up. We do not sell, rent, or share your information with third parties for marketing purposes.

4. Lawful Basis

We process your information on the basis of your consent (when you submit the enquiry form), and to perform the rental agreement once a booking is confirmed.

5. Data Retention
